Is “Rosé All Day” trademarked?

This page is informational only and is not legal advice. Trademark status can change; confirm with the USPTO or a trademark attorney.

The short answer

Status: No longer registered. None of the exact-match USPTO records we checked are live (checked Oct. 18, 2026, about 3:10 PM PT).

Not anymore, based on what we checked. ROSE LIFESTYLE LLC once held two registrations for ROSÉ ALL DAY, one for T-shirts and tote bags and one for mugs and wine accessories. Both have been cancelled (in 2022 and 2024) because no Section 8 declaration was filed. A third application, for swimwear, glasses and notebooks, was abandoned in 2019.

Goods text is quoted from the USPTO record and shortened where marked “…”. Classes listed are international classes. A dash (—) means no registration has issued.

Mark type matters. A standard-character mark covers the wording itself, in any font or style. A stylized or design (logo) mark is registered as shown, and how far it reaches to the same words in plain text is fact-specific. A trademark attorney can tell you how it applies to your design.

About this check. This page lists only the 3 USPTO records shown above. We picked them from a limited sample of search results (the top 100 results per phrase search, when a common phrase can have thousands of related filings) and verified each one on its USPTO TSDR status page. Other filings, live or dead, may exist. Where this page says "none," it means none in the records we checked.

What it means for your products

Shirts and bags (classes 25, 18). Reg. No. 4867144 covered T-shirts and tote bags. TSDR shows it cancelled on June 24, 2022.

Mugs and wine accessories (class 21). Reg. No. 5476088 covered mugs, coffee mugs, wine openers and ice buckets. It was cancelled on Dec. 6, 2024.

Stickers, notebooks, glassware (classes 16, 21, 25). Serial 86935158 was an intent-to-use application for notebooks, wine glasses, tumblers and swimwear. It was abandoned in April 2019 when no Statement of Use was filed.

What this means. These records no longer give federal registration rights. But a former owner may still have common-law rights if it's still selling, and new filings can appear. The accent doesn't matter: "Rose All Day" and "Rosé All Day" would be compared as the same phrase.

Variant ideas (not guaranteed to be clear)

Variants are starting points, not clearances. Any new wording can match a record we didn't list or a filing made after our check. Run every final phrase through a search before you list it.
